The right to use the website for searching for information or making bookings is only given to persons older than 18 years, individuals, juridical persons, or representatives of institutions or companies. We reserve the right to change the website or parts of it and its content whenever we consider it necessary. Although every effort has been made to ensure the accuracy of the information give on the website, the information provided is only informative material and is dependent on a third party. As such we cannot be held responsible for the information.

2. RESERVATIONS / BOOKINGS

Open House Spain S.L. accepts requests only through correctly filled in forms on our site. All questions regarding confirmations, services details, cancellations must be made by e-mail or fax, in writing or in person. With making a reservation the prospective customer agrees to conclude a contract according to the (here available) conditions and will be called from here on client. By sending back a confirmation of booking by Language-Finder.com (in the name of Open House Spain S.L.) by e-mail, fax or mail a valid contract is made. The client has to verify that all the dates in the confirmation email are correct and to notify to Open House Spain S.L. within three days of any possible changes. Failure to notify us within this period will mean, that the client accepts the reservation as stated. The correction of mistakes due to typing or calculation errors is reserved. The client is the sole responsible to all obligations, which could follow the contract and will be responsible for all the persons included in his/her reservation.

The availability of Spanish Courses has to be confirmed by the school, especially in high season. In the case that your requested course is not available, all the personal information, as well as that of the credit card will be erased immediately. In the case of bank transfers they will be returned.

3. SPECIFIC CONDITIONS FOR RESERVATIONS

When making a reservation it takes usually 1-3 days to confirm a customer’s reservation depending on conditions like the number of requests received per day, the availability of courses at the time of receiving his/her request and the receipt of the prepayment in our bank account. The reservation becomes effective the moment that Open House Spain S.L. receives the money due in our bank account, in cash, or, in case of bank transfer, the fax receipt of the transfer wire.The contract text of all reservations is stored and you can see the Terms&Conditions(T&C) of the contract at any time on this page. The specific order data are not recallable for reasons of safety on Internet and are treated in accordance with our data security regulations confidentially.

4. RATES

All rates are quoted in euros (€)and will always be confirmed when Open House Spain S.L. invoices the client. Before booking online you will be shown the total price, including VAT, as well as a breakdown of the amounts you are paying for.

5. SERVICE ORDERS:

When pressing the book now button after filling in all your personal dates and credit card details the user authorises Open House Spain S.L. to charge his/her credit card (or other approved facility) for any and all purchases of services made by him/her through Open House Spain S.L. He/ She agrees not to report as lost or stolen any credit card which he/she has used in conjunction with payment to Open House Spain S.L. for services which he/she does not have good reason to believe is, in fact, lost or stolen. He/she further agree not to report as unauthorised any charge for services which he/she has, in fact, ordered from Open House Spain S.L. He/she agrees that any such false reporting of a lost or stolen credit card or of unauthorised charges shall render him/her liable to Open House Spain S.L. The liability for liquidated damages specified in this Paragraph shall not limit any other liability he/she may have for breach(es) of any other terms, conditions and warranties set forth in this Agreement.

6. PAYMENT:

Open House Spain S.L. will send to you the booking confirmation for the Spanish course, as soon as they receive the prepayment by bank transfer (or the fax copy of the wire transfer as a proof) or after having charged your credit card for the amount of the prepayment. The outstanding balance stated on the booking confirmation must be paid directly to the language school on arrival.

7. METHODS OF PAYMENT:

We accept payment by credit cards (Visa, EuroCard/MasterCard, American Express and JCB) and by bank transfer. Customers must pay all bank commissions that may occur. If you pay by bank transfer, please indicate your name on all transfer documents. It is very important to send us the receipt of the wire transfer (with your name, passport nr., complete address, telephone and email address) by fax. We can only reserve the language course after we have received this fax.

8. INVOICES

If an invoice is required for the total amount of a reservation, please contact us before making the booking.

9. SECURIZATION OF PAYMENTS BY CREDIT CARDS

This website takes every precaution to protect our users information. When users submit sensitive information via the website, their information is protected both online and off-line. When our registration/order form asks users to enter sensitive information (such as credit card number), that information is encrypted and protected with the best encryption software in the industry – SSL and PGP. While on a secure page, such as our order form, the lock icon on the bottom of Web browsers such as Netscape Navigator and Microsoft Internet Explorer becomes locked, as opposed to un-locked, or open, when you are just surfing. While we use SSL encryption to protect sensitive information online and PGP to protect all transmission, we also do everything in our power to protect user-information off-line. All of our users information, not just the sensitive information mentioned above, is restricted to our offices. ALL employees are kept up-to-date on our security and privacy practices.

10. CONFIRMATION

A booking confirmation will be send within 24 hours after the request is made except over the weekend. All email enquiries will be responded within 24 hours after the request is made except over the weekend. Our offices close on Friday afternoon at 17.30 and reopens on Monday morning at 08.30 Spanish time.

11. CANCELLATIONS

All cancellations must be made by e-mail or fax to the manager. Please note that our conditions for cancellation differ depending on when the cancellation is made, except for the cases stated in the section Exceptions below. Cancellations of Spanish courses: Our conditions for the cancellation depend on when the client cancels the reservation.

76 or more days before arrival: Full refund of the prepayment.

46 until 75 days before arrival: 50% refund of the prepayment

45 days before arrival or less: There is no refund.

12. CHANGES OF BOOKINGS:

To change a booking, it is necessary first to cancel the one you want to change and then to make the new one.

13. EXCEPTIONS:

Full refund of the prepayment will be granted regardless of time in the case of serious illness, serious injury or the death of the client. Illness or serious injury is defined as the complete deterioration of health or a disabling infection which prohibits the client from leaving his place of residence, or place of hospitalisation (where the client is undergoing treatment) on the date of the commencement of the course. A signed doctor´s note must justify this.

We recommend for these reasons that you take out travel insurance.

14. CASE OF FORCE MAJEUR

The tenant is not freed from the responsibility of payment due to personal circumstances or force majeur such as war, strikes or natural catastrophes.

15. DESCRIPTION OF SPANISH COURSES

All information on the language schools, including courses and prices, is provided by the language schools. Open House Spain S.L. does its very best to verify this information and keep it up to date, but Open House Spain S.L. can never be held liable for the content in the descriptions.

16. PRIVACY POLICY

Open House Spain S.L. wants to demonstrate its commitment to your privacy. If you are interested in learning more about what personal information is being gathered by our site, who is collecting the information, how the information will be used or with whom the information will be shared with, please consult our PRIVACY STATEMENT.

17. CLAIMS

In case of claims against the school you have to communicate them immediately to the school. If not you will loose all rights of compensation. If the reasons for the claim have not been eliminated in an appropriate period of time it has to be communicated to Open House Spain S.L. Any demand of compensation has to be presented in written form to Open House Spain S.L. within one month. Later demands cannot be respected.

18. RESPONSIBILITY

Open House Spain S.L. acts as an agent for the enrolment for language courses. Therefore Open House Spain S.L. can never be responsible for delays, accidents, losses, changes of schedules and rates, damages, etc. (neither for persons nor for objects), that may occur in any of its suppliers services.

Open House Spain S.L. or its employees are not responsible for:

· errors, omissions, or misspelled words
· misrepresentation by third parties
· personal damages or injuries incurred while staying in one of the schools of this Web site
· disputes between a consumer and a third party
· content of external links you will find on our website

The service of Open House Spain S.L. ends with the preparation and with issuing of the documents of your booking. This can be by email, fax, personally in the office of Open House Spain S.L. or by mail if the client so wishes. In the last case Open House Spain S.L. reserves the right to charge an additional 25 euros.

Open House Spain S.L. is responsible to exercise the diligence of a respectable business for the conscientious preparation, the careful monitoring and selection of the service providers and the respectable contribution of the agreed services taking into consideration local and national customs. Open House Spain S.L. does its very best to verify all the information that content the web site www.language-finder.com and to keep it up to date, but Open House Spain S.L. can never be held liable for its content. The responsibility of Open House Spain S.L. is limited to the total amount of the services paid for.

19. WITHDRAWAL BY OPEN HOUSE SPAIN S L

Open House Spain S.L. can withdraw from the contract without any grace, if the tenant regardless of a warning by Open House Spain S.L. disturb the peace or behave contrary to the terms of the agreement in such a degree that the immediate annulment of the contract is justified. If we terminate for the reasons specified above, then our claim to the entire rent remains.

20. NOTICE

Any notice to Open House Spain S.L. should be sent to info@language-finder.com or by fax to + 34 93 3040566 (Spain) during normal business hours. You must promptly inform Open House Spain S.L. of changes in the expiration date of any credit card used in connection with the services; changes in home or billing address; and any actual or suspected apparent breaches of security, such as loss, theft, or unauthorized disclosure. Until Open House Spain S.L. is notified of a breach in security, you will remain liable for any unauthorized use of the services. Open House Spain S.L. will provide you with copies of billing records documenting charges for use of the services upon request.

21. SALVATORI CLAUSE

If a rule of this agreement should be explained by a responsible court for illegal, that does not touch the validity of the other regulations. If a rule of this agreement is ineffective only in a section, then the other sections keep their validity.

22. AREA OF JURISDICTION

As sole area of jurisdiction for suits against Open House Spain S.L. Barcelona is agreed.

23. TRADEMARKS

Open House Spain S.L. and other graphics, logos, and service names appearing on this site are the trademarks of Open House Spain S.L. or its respective content suppliers. These trademarks may not be used in connection with any product or service that is not provided by Open House Spain S.L. or by its respective content suppliers, in any manner that is likely to cause confusion amongst customers, or in any manner that disparages or discredits the company.
